There is no longer any legal impediment for Sarwar Alamgir, the Bangladesh Nationalist Party (BNP) candidate elected from the Chittagong-2 (Fatikchhari) constituency in the 13th National Parliamentary Election, to discharge his duties as a Member of Parliament.
The Appellate Division of the Supreme Court has struck off from its cause list an application seeking an injunction against his participation in parliamentary sessions.
A four-member bench of the Appellate Division, headed by Chief Justice Zubayer Rahman Chowdhury, issued the order today, Wednesday.
Court Observations and Legal Opinions
Speaking to journalists following the court’s order, Attorney General Md. Asaduzzaman (or Attorney General Md. Ruhul Quddus Kajal, as noted in the source text) stated that the Appellate Division decided to drop the petition from the cause list as the full judgment of the High Court was recently published. Consequently, Sarwar Alamgir’s path to remaining an MP and participating in parliamentary proceedings is now completely free of legal hurdles.
On the other hand, Advocate Mohammad Shishir Manir, representing the writ petitioner, stated that after receiving a certified copy of the High Court’s full verdict, they would file a “Leave to Appeal” in the Appellate Division to challenge it. However, he conceded that unless a new stay order is granted, Sarwar Alamgir can fully perform his duties as a Member of Parliament.
